1. About these Terms

These Terms of Use govern registered access to DM Noctem, including Player Profiles, Characters, Campaigns, Sessions, community features, Discord-connected features, Black Rook Radio controls, and related member services. By creating or continuing to use a DM Noctem member account, you agree to these Terms and the Community Guidelines.

2. Eligibility

DM Noctem member accounts are intended for people who are at least 18 years old. We do not require a birth date; members confirm that they satisfy this eligibility rule when accepting the current policies.

3. Accounts and security

You are responsible for information submitted through your account and for keeping your login credentials secure. Do not share another member's account, impersonate another person, attempt to defeat access controls, or use another member's private information without permission.

4. Profiles, Characters and user content

You keep ownership of content you create or upload. By submitting content to DM Noctem, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, resize, format, display and distribute that content only as reasonably necessary to operate, moderate, back up, promote or improve DM Noctem and the Campaign/community features in which you chose to place it. You represent that you have the right to submit the content.

Do not upload material that unlawfully infringes another person's copyright, trademark, privacy, publicity or other rights. Staff may remove or restrict content when reasonably necessary for moderation, security, legal compliance or operation of the service.

5. Campaigns, GMs and community tools

Campaign access, GM permissions, roster membership, recruiting, Campaign Board activity, Session participation, Renown, Achievements, Mystery Rewards and Kudos are community features. They are not property, currency or guaranteed entitlements. Staff may correct records, resolve access issues, moderate abuse, archive Campaign material or adjust features when reasonably necessary.

6. Conduct and moderation

You must follow the Community Guidelines. DM Noctem may warn, restrict, suspend or remove accounts or content for violations, security concerns, abuse, legal requirements, or conduct that materially harms the community or service. Severe conduct may result in immediate action.

7. Third-party services

DM Noctem may integrate with third-party services such as Discord, WordPress, hosting/CDN/security providers, and Black Rook Radio infrastructure. Those services may have their own terms and privacy practices. Connecting or opening a third-party service may transmit information to that provider as described in the Privacy Policy.

8. Availability and changes

DM Noctem is provided on an as-available basis. Features may change, be unavailable, contain errors, or be retired. We do not promise uninterrupted availability or permanent retention of every user-created item. Members should keep copies of material they cannot afford to lose.

9. Disclaimers and limitation

To the fullest extent permitted by law, DM Noctem and its operators disclaim implied warranties regarding the service and are not liable for indirect, incidental, special, consequential or punitive damages arising from use of the service. Nothing in these Terms limits rights or liabilities that cannot legally be limited.

10. Ending membership

You may submit an account deletion request from Privacy & Account. Some records may be retained when needed for security, audit integrity, dispute resolution, Campaign history, legal obligations or the rights of other members. We may suspend or terminate access as described above.

11. Governing law

Unless applicable law requires otherwise, these Terms are governed by the laws applicable in Florida, United States, without regard to conflict-of-law principles.

12. Changes to these Terms

Material changes may be issued as a new policy version. When a new version is marked as requiring review, members must accept it before continuing to use protected DM Noctem member features.
